FlightsPath, operated by Blu Skye Distribution, Inc., may offer users the option to receive SMS text messages, including account verification and security messages.

Enrollment in the FlightsPath SMS messaging program requires a separate, affirmative opt-in by the user. Acceptance of these Terms of Service does not constitute consent to receive SMS text messages.

Participation in the SMS messaging program is voluntary and is not a condition of purchasing a product or service.

Message frequency varies. Message and data rates may apply.

Users may reply STOP to opt out of SMS messages and HELP for assistance.

Wireless carriers are not liable for delayed or undelivered messages.

SMS opt-in data and consent will not be sold, rented, transferred, or shared with third parties for their marketing purposes.

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Blu Skye Distribution, Inc. (“Blu Skye,” “Company,” “we,” “us,” or “our”), doing business through the FlightsPath and Flywithazureskye brands.

These Terms govern your access to and use of the FlightsPath mobile application, Flywithazureskye website, aviation educational materials, FAA knowledge-test preparation resources, ground-school services, subscriptions, training services, and other related products and services (collectively, the “Services”).

By creating an account, purchasing a subscription, accessing the Services, or otherwise using FlightsPath or Flywithazureskye, you acknowledge that you have read and agree to these Terms.

Throughout these Terms, references to “FlightsPath” or “Flywithazureskye” refer to brands, products, or services operated by Blu Skye Distribution, Inc., unless otherwise expressly stated.

Independent Educational Service

Blu Skye Distribution, Inc., FlightsPath, and Flywithazureskye are independent aviation education and training services.

Unless expressly stated otherwise, Blu Skye Distribution, Inc., FlightsPath, and Flywithazureskye are not affiliated with, sponsored by, endorsed by, or operated by the Federal Aviation Administration (“FAA”), U.S. Department of Transportation, PSI Services, or any other governmental testing or certification authority.

References to the FAA, FAA regulations, Airman Certification Standards, aviation publications, certificates, ratings, examinations, or other governmental materials are provided for educational and informational purposes.

FlightsPath SMS Messaging Terms

FlightsPath is an aviation education and pilot test-preparation service operated by Blu Skye Distribution, Inc.

Users who voluntarily enroll in FlightsPath SMS messaging may receive account notifications, verification or security messages, customer-support communications, aviation course and study notifications, and other service-related FlightsPath updates.

Message frequency varies. Message and data rates may apply.

You may opt out of FlightsPath SMS messages at any time by replying STOP. After opting out, you will no longer receive messages from that SMS program unless you subsequently opt in again.

For assistance, reply HELP or contact FlightsPath customer support.

Wireless carriers are not liable for delayed or undelivered messages.

Participation in the FlightsPath SMS program is voluntary and is not a condition of purchasing, registering for, or using FlightsPath services.

No Guarantee of FAA Examination or Certification Results

FlightsPath provides educational and test-preparation resources. Blu Skye Distribution, Inc. does not guarantee that use of FlightsPath or Flywithazureskye will result in:

Passing an FAA knowledge examination;
Passing an FAA practical test or checkride;
Receiving a pilot certificate, rating, or endorsement;
Completing any FAA training requirement; or
Obtaining aviation employment.

Users are responsible for satisfying all applicable FAA eligibility, training, aeronautical experience, endorsement, testing, medical, and certification requirements.

For purposes of contracts, payments, subscriptions, legal notices, intellectual-property rights, limitation-of-liability provisions, and other legal obligations contained in these Terms, the contracting business entity is:

Intellectual Property

Except for third-party materials, public-domain governmental materials, and materials otherwise identified as belonging to another party, the proprietary FlightsPath and Flywithazureskye software, branding, logos, original educational content, graphics, designs, databases, interfaces, and related intellectual property are owned by or licensed to Blu Skye Distribution, Inc.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BLU SKYE DISTRIBUTION, INC., INCLUDING ITS FLIGHTSPATH AND FLYWITHAZURESKYE BRANDS, AND ITS OFFICERS, DIRECTORS, EMPLOYEES, INSTRUCTORS, CONTRACTORS, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO USE OF OR INABILITY TO USE THE SERVICES.

Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded.
